Terms of Sale

Article 1 - Purpose

These Terms of Sale (ToS) govern the sales of services carried out on the ExcelifyXML website, operated by the SASU To The Rock (SIREN 940 692 874), and define the rights and obligations of the parties in the context of online sales of the services offered.

Article 2 - Services Offered

ExcelifyXML offers different subscription plans to access the XML transformation service:

Article 3 - Pricing

Prices are indicated in euros including all taxes (VAT), French VAT of 20% included. Businesses in the European Union with a valid intra-community VAT number benefit from reverse charge (0% VAT). ExcelifyXML reserves the right to modify its prices at any time, it being understood that the price shown at the time of ordering will be the only one applicable to the buyer.

Article 4 - Payment

Payment is made online by credit card via the secure Stripe platform. Payment is due immediately upon ordering. Subscriptions renew automatically at each billing period, monthly or yearly depending on the chosen plan.

Article 5 - Right of Withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for services fully performed before the end of the withdrawal period and whose execution began after the consumer's prior express consent.

By using the Service after subscription, you acknowledge that the service execution begins immediately and expressly waive your right of withdrawal.

Waiver of the right of withdrawal requires the express prior consent of the User, collected via a checkbox during the payment process. Without this acceptance, the order cannot be finalized.

Article 6 - Termination

The User can terminate their subscription at any time from their personal space. Termination takes effect at the end of the current billing period.

ExcelifyXML reserves the right to terminate a User's subscription in case of non-compliance with the ToS, without refund of amounts already paid.

Article 7 - Service Availability

ExcelifyXML strives to ensure maximum availability of the Service. However, ExcelifyXML does not guarantee continuous availability and cannot be held liable for service interruptions, whether planned or not.

Article 8 - Warranties

ExcelifyXML guarantees that the Service will be provided in accordance with its description. In case of non-conformity, the User may:

• Request correction of the service
• Obtain a proportional price reduction
• Terminate their subscription in case of serious breach

Article 8 bis - Legal Guarantee of Conformity

In accordance with Articles L217-3 to L217-13 of the French Consumer Code, the consumer benefits from the legal guarantee of conformity for digital content and services. In case of non-conformity, the consumer is entitled to have the service brought into conformity, or failing that, to a price reduction or contract termination.

Article 9 - Personal Data

Personal data collected during ordering is necessary for managing your account and billing.

Article 10 - Applicable Law

These ToS are governed by French law. Any dispute relating to their interpretation or execution will be submitted to the competent courts of Lille.

If you experience any difficulty using the service or have a complaint about an order, please contact our support first at support@excelifyxml.com. We are committed to acknowledging every complaint and seeking an amicable resolution as quickly as possible.
